Recent legislation has put a final nail in the coffin for a proposed landfill on Silver Creek Road. With the passage of House Bill 3071 in the most recent legislative session and the creation of a new Tarrant County ordinance, the site’s longstanding permit is canceled and cannot be renewed.
Two years ago, BAP Kennor Landfill LLC applied to build a demolition waste materials recycling facility at 3411 Silver Creek Road. During a Dec. 5, 2023, public meeting at Brewer High School, area residents and local politicians spoke out against the proposed project citing health, environmental and infrastructure concerns.
The permit was originally filed in 1980 and BAP Kennor hoped to transfer the existing application into its name. After resistance from the public and the Tarrant County Commissioner’s Court the company withdraw its application in the spring of 2024. Fears that another company could attempt to establish a future landfill at the site remained alive after now defunct state laws allowed the original permit to remain active and transferable. In February, Texas District 99 Rep. Charlie Geren authored House Bill 3071 permanently canceling the landfill permit at the site. Over the last few months, the bill was passed by the Texas House and Senate and was eventually signed by Gov. Greg Abbott.
